Unlimited Plan Acceptable Use Policy
1. About this document
This Unlimited Plan (UP) Acceptable Use Policy applies to services offered by Teleca and must be read in conjunction with its Policies and Procedures.
2. Small Business Use
(a) The UP is offered to ‘small businesses’ operating within Australia. A ‘standard small sized business’ is defined as a business that engages in normal trading activities, during standard business hours applicable to businesses located within their geographic region. This plan has been specifically designed for startups, self-employed tradespersons, home-based businesses and small office-based businesses who are seeking to eliminate the prospect of billshock for business budgeting purposes.
(b) The UP is not offered to any competitor, existing customer, Carriage Service Provider, reseller, call centre, hotline or answering service, automated service, automated dial system, automated responder system, DID range phone system, any business operating 24/7, or business with dedicated staff to answered calls or the like. Unless otherwise agreed in writing, these features are not permitted as free inclusions: State Based Routing, Areas Based Routing and Post Code Prompting.
(c) A UP service may only receive calls from within Australia from an Australian landline or Australian mobile service and can only divert to an Australian landline or Australian mobile service. All other call types will be chargeable at the call rate to applicable to the current call rates for that particular call type.
(d) A UP may have a technical limitation restricting them from being forwarded to 1300, 1800, 13, 19 numbers, emergency services (000), directory assistance services, international calls, Satellite numbers and the like.
3. Excessive And/Or Unreasonable Use
(a) Teleca performs ongoing excessive and/or unreasonable pattern detection of all call types and volumes used by ‘small businesses’ and has developed our fair usage profile. The fair usage profile is used to assess whether the UP call types and/or volumes are deemed by Teleca, at its sole discretion, to be excessive and/or unreasonably used.
(b) To ensure there is no misunderstanding, call patterns of any service detected beyond deemed a ‘small business’ is deemed unreasonable use.
4. Prohibited Use
Where any service is offered and used under the UP, you are not permitted to:
(a) Cause the use of any device to reroute calls to or from our network or to reroute calls to or from the network of another supplier, set up any switch device or the like purposed to keeping a call or session open for an extended period of time so as to commercially prejudice Teleca or;
(b) Operate a high frequency call volume business, a telephone-based marketing business, call centre or other call distribution centre or the like or;
(c) Cause network instability or;
(d) Deny access to the Teleca network by any other of its customers or;
(e) Re-supply or resell any service on our network, unless otherwise permitted in writing or;
(f) Forward calls to a call centre, a business providing call centre services, department or team whose predominant task is to answer calls or to queue calls or;
(g) Create a business announcement that directs callers to a website, phone number, email address or any media or;
(h) Use our services in for a business that operates any service that is available 24/7 (with some exceptions) or;
(i) Use our services to replace an existing high capacity or high usage service or;
(j) Use our services to forward to other 1300, 1800, 13, 19, international DID or any other number that attracts call rates (including flagfall
rates).
(k) Use our services to operate a high frequency marketing campaign, hotline or special offer.
5. Permitted Use
Not withstanding clauses 3 and 4, Teleca may, in its absolute discretion, grant a UP to other than a “small business”.
6. Breach Remedy or Termination
(a) If We determine you are in breach of this Policy, may elect to terminate our agreement in accordance with Our Standard Form Agreement and;
(b) Immediately and without any prior warning or notice to you, limit, restrict, suspend or cancel the service and;
(c) Immediately and without any prior warning or notice to your, from the time and date of the Breach remove the Unlimited Plan and replace it with the $100 Enterprise Plan with calls at 12c/minute (plan includes $120 worth of calls) and;
(d) Immediately and without any prior warning or notice to you, re-rate calls from the time and date of the Breach at 12c/min + GST for landline destination and 12c/min + GST for mobile destination and;
(e) At our sole discretion, may issue You with a notice to transfer the breached service to another Provider.
